Park and parking regulations

The entire team at Ziegler Playgrounds from A to Z, the operator of the enchanting adventure world ArkaZien (hereinafter referred to as "ArkaZien" or "we"), wishes you a pleasant stay and lots of fun exploring the park. Beforehand, we would like to point out some rules and guidelines that apply to visitors of our park (park and parking lot).

The following rules of our park regulations must be strictly observed:

1. Parking

1.1 The rules and signs of the German Road Traffic Regulations (StVO) apply in our parking lots. Driving at walking speed is mandatory. Pedestrians must be given due consideration.

1.2 Visitors must park their vehicles in designated visitor parking areas. Employee parking spaces may only be used by park staff.

1.3 Please follow the instructions of our parking attendants to ensure a smooth arrival and departure process. Vehicles must be parked within the designated parking areas. Vehicles that are not parked properly and obstruct traffic may be towed at the owner's expense and risk.

1.4 The designated parking areas are not monitored by us. Therefore, please ensure that your vehicle is locked when you leave it. Furthermore, for your own safety, please do not leave any valuables visible in your car. Animals are also not permitted in vehicles.

1.5 We are not liable for theft or damage to your vehicle by third parties, nor for damage caused by storm, fire, hail, explosion and other extraordinary events.

2. Access authorization

2.1 The park grounds may only be entered with a valid ticket and only via designated visitor entrances.

2.2 Tickets generally entitle the holder to enter and remain on the park grounds only during the posted opening hours. If tickets are issued for a specific entry time, entry to the park can only be demanded at the designated time. Unused tickets expire without replacement. Park staff will decide on any exceptions, such as later entry or issuing a ticket for a later date, on a case-by-case basis. There is no entitlement to such exceptions. No refunds will be issued.

2.3 An admission ticket generally only entitles you to one entry to the park grounds. Should you need to leave the park temporarily for urgent reasons, please contact the staff at the entrance control. There, you may be able to obtain permission to re-enter the park later with a valid stamp.

2.4 Children under the age of 12 are only permitted entry when accompanied by an adult. Parents or guardians are responsible for the safety of the children in their care and must diligently exercise their supervisory duties. They are liable for any damage caused by the children under their supervision.

2.5 Different entry rules may apply to special events. Information about these rules can be found on our website, in any available event brochures, and of course from park staff.

2.6 The (re)sale of tickets, vouchers or free tickets is not permitted.

2.7 Dogs and other pets are not allowed on the park grounds.

3. Access and stay restrictions

3.1 We ask for your attention and understanding that, for the safety of visitors and employees, the following items are prohibited on the entire park grounds:

➢ Bottles and other glass containers,

➢ Weapons, replica weapons and dangerous objects such as knives, brass knuckles, pepper spray, stun guns, fireworks and other pyrotechnic products,

➢ Drones and other remote-controlled devices and toys,

➢ Clothing or other items with discriminatory, violence-glorifying, unconstitutional or otherwise illegal inscriptions or symbols,

➢ Motorized or non-motorized means of transport such as roller skates, bicycles, e-scooters, unless they are required for health reasons (e.g. wheelchairs).

If you are carrying valuables, please use our lockers at the main entrance to store them safely during your visit to the park. We accept no liability for them.

3.2 Every visitor wishing to enter the park grounds expressly agrees to voluntarily submit to a possible check by our entrance and security personnel and to fully comply with their instructions. If such a check is refused, entry to the park may be denied or the visitor may be required to leave the park.

3.3 Entry to the park may be refused to persons if and as long as they are carrying items listed under point 3.1. If they are already in the park, they may be asked to leave.

3.4 Park staff are authorized to remove visitors from the park or deny them entry if they are deemed a safety risk due to alcohol or drug use or for other reasons.

3.5 Tickets must be kept with you while in the park and shown upon request by park staff. Anyone unable to present a ticket may be asked to leave the park.

3.6 If the park has to close prematurely due to weather-related, technical, organizational or other reasons for which we are not responsible due to intent or gross negligence, there is no entitlement to a full or partial refund of the admission price.

4. General rules and safety regulations

4.1. Wearing sturdy footwear is mandatory.

4.2 The instructions of the park staff must be followed without exception at all times.

4.3 To ensure all visitors have a wonderful and unforgettable time with us, we expect respectful and considerate behavior towards other visitors. Unnecessary noise should be avoided. Insults and verbal abuse are prohibited.

4.4 Areas closed to visitors, such as service roads and commercial areas, must not be entered. Ropes, fences, walls, and other barriers must not be crossed.

4.5 Feeding wild animals is not permitted. Fishing, bathing, and swimming in the park's artificial and natural bodies of water are only allowed in designated areas and are otherwise prohibited.

4.6 Advertising or offering goods and services on the park grounds and the associated parking lots is only permitted with prior written approval from the park management.

4.7 Waste must be disposed of exclusively in the designated containers. Littering and other forms of pollution of the park grounds are prohibited.

4.8 The fire safety regulations in the park must be strictly observed. Barbecuing and open fires of any kind are strictly prohibited throughout the entire park.

4.9 Smoking is prohibited throughout the entire park (including e-cigarettes). Exceptions are only permitted in designated areas.

4.10 Alcohol, cannabis, and illegal drugs are not permitted in the park.

4.11 Consumption of food and drinks brought from home is permitted.

5. Use of the playground equipment and other facilities

5.1 The playground equipment and other facilities in our park are generally open to all visitors for their intended use. However, any specific age restrictions or other information limiting the permitted user group is binding and must be strictly observed.

5.2 The opening hours of individual areas and facilities within the park may differ from the park's overall opening hours. An admission ticket does not guarantee the use of specific play equipment or facilities. If individual pieces of equipment, areas, or facilities are temporarily closed for technical or other reasons, there is no entitlement to a partial or full refund of the admission price.

5.3 Any safety and usage instructions must be read before use and followed during use. Safety devices must be used. Any use that endangers safety and/or is improper is prohibited.

5.4 Visitors may only use the park's play equipment and other facilities if they are in a suitable state of physical and mental health. Park staff are authorized to exclude individuals from using certain equipment or facilities for safety reasons, such as size, build, physical or mental limitations, permanent or temporary disabilities, pregnancy, etc. Exclusion for safety reasons does not constitute discrimination but is solely for the protection of your health and safety.

5.5 All facilities in the park are carefully maintained and monitored. However, should any damage or potential safety-related defects be discovered on individual playground equipment or other park facilities, further use of the affected equipment or facilities must be stopped immediately. Any damage or defects discovered must be reported to park staff without delay.

5.6 We ask our visitors to treat all playground equipment and other park facilities with care. Visitors are liable for any damage caused by disregarding the rules of use or by willful damage.

6. Photo and video recordings

6.1 Taking photographs and videos for private purposes is permitted in the publicly accessible areas of the park, provided that other guests are not inconvenienced or their rights are violated.

6.2 Photography and video recordings for commercial purposes, recordings for TV programs, live streaming via online platforms, and all other recordings with commercial intent require prior filming permission. For inquiries regarding this, please contact: presse@arkazien.de.

6.3 The use of drones is strictly prohibited for visitors throughout the entire park.

6.4 For data protection reasons, taking photos and videos of our employees is not permitted. Any recordings made in violation of this rule will be deleted upon request.

6.5 Photo and video recordings are occasionally made on the park grounds for advertising and marketing purposes. Recording areas are marked where possible. If you do not wish to appear in any recordings, we recommend that you avoid the recording areas during filming or inform the film crew.

7. Damage reports

7.1 Any damage you may incur while using the park's playground equipment and other facilities, through no fault of your own, must be reported to us immediately – before leaving the park. Please also report any incident during your visit to the park if you have reason to believe that it could result in damage for you later on.

7.2 If you have suffered any damage caused by the park staff, please inform us immediately, ideally while still in the park, provided this is reasonable for you.

8. Liability

8.1 Staying on the grounds of the ArkaZien Park in Beiersdorf and using the park's facilities, playground equipment and attractions is at your own risk.

8.2 We are liable for damages caused by a culpable breach of a fundamental contractual obligation by us or our employees, or resulting from gross negligence or intent. However, in the case of a breach of a fundamental contractual obligation, liability for simple negligence is limited to the foreseeable damages typical for this type of contract. This does not affect liability for injury to life, body, or health, liability under the Product Liability Act, liability for fraudulently concealed defects, or liability arising from the assumption of a guarantee for the quality of a product.

8.3 We accept no liability for personal belongings brought onto the park grounds by visitors. This applies in particular to items that are damaged, destroyed, or lost while using the facilities, play equipment, and attractions in our park (e.g., mobile phones, jewelry, cameras, clothing, etc.). Liability is also excluded for loss or damage to items handed to park employees or left on the park grounds. Lockers are available at the park entrance where valuables can be safely stored during your visit.

8.4 We are only liable for any fault on the part of our employees in cases of gross negligence or intent.

9. Right of domicile

We reserve the right, at our discretion and without refunding the entrance fee, to remove persons who violate these parking regulations from the parking area and to issue a ban on future entry.

10. Loss report

If you have lost an item in ArkaZien, please send an email with the following information to info@arkazien.de:

· Name/ Contact details
· What has been lost / forgotten?
· When has it been lost / forgotten?

If the item is found, you can collect it in person at the checkout area or have it sent to you as an insured package at your own expense.

11. Data protection

All personal data is protected in accordance with data protection regulations, in particular the GDPR and the German Federal Data Protection Act. In the event of violations of the park regulations, the offending person must present their identity card or passport as proof of identity if a ban from the premises is to be issued. Individuals against whom a ban from the premises and entry to ArkaZien is issued are listed in a ban list. This list contains only data necessary for the unambiguous identification of the individuals and thus for the enforcement of issued bans. This typically includes: name, address, date of birth, and place of birth. Storage is based on Article 6 Paragraph 1f) GDPR, as we have a legitimate interest in identifying the individual in question and monitoring the enforcement of the ban in cases of violations of our house rules. Personal data stored in connection with violations of the parking regulations or when issuing bans from the premises will be deleted immediately if it is no longer required to achieve the purpose for which it was collected and if the legitimate interests of the data subjects preclude further storage.

12. Final Provisions

12.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

12.2 The European Commission has established an online platform for dispute resolution. This platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link: https://ec.europa.eu/consumers/odr/main/. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

12.3 Should individual provisions of these parking regulations be or become invalid, the validity of the remaining provisions shall not be affected.
